Subcommittee examines impact of Indian Trust Asset Reform Act

The Subcommittee on Indian and Insular Affairs convened to discuss Indian Trust Asset Management. Subcommittee Chairman Jeff Hurd (R-Colo.) emphasized the importance of the hearing, stating, "Today’s hearing was a continuation of our subcommittee's critical work to elevate tribal autonomy while reiterating the trust responsibility of the federal government toward American Indians and Alaska Natives. I want to thank all of our tribal witnesses for traveling here today to speak on this important issue and look forward to working with them further as we implement solutions that empower tribes to thrive."

The hearing focused on the Indian Trust Asset Reform Act (ITARA), enacted by Congress in 2016. This legislation aimed to reaffirm the federal government's trust responsibility and promote tribal management through the Indian Trust Management Demonstration Program. The authorization for this program is set to expire in 2026.

Despite ITARA's objective of granting tribes more authority over their trust assets, only a few tribes have submitted plans since its inception nearly a decade ago. As Congress deliberates on reauthorizing the program, there is a need to assess both the scope of trust assets included in an Indian Trust Asset Management Plan and any bureaucratic hurdles that may limit tribal participation.
